GDPR-compliant hosting: does the server have to be in Germany?

"Hosted in Germany" appears on many offers as if it were the key to data protection. But the GDPR doesn't require a server in Germany. What matters is the contract, security and where data actually flows. This article shows what counts when choosing hosting and which questions to ask the provider.

What the GDPR actually requires

The host processes personal data for you, such as IP addresses in server logs and form submissions. That requires a data processing agreement under Article 28 GDPR and appropriate technical and organisational measures under Article 32. A server in the EU or EEA makes things simpler because there's no transfer to a third country. Germany isn't stricter here than France or Finland.

US providers and cloud platforms

Many modern platforms belong to US companies. For certified companies, the EU-US Data Privacy Framework adequacy decision has applied since 2023; the EU General Court upheld it in 2025, and an appeal is pending. With such providers choose an EU region and check the certification and sub-processors. If you want to avoid the risk of a later ruling entirely, pick a provider headquartered and hosting in the EU.

Security and availability

Ask the provider about these points:

  • Automatic backups at a second location and a tested restore path.
  • A TLS certificate with automatic renewal and HTTPS redirect.
  • Current server software, such as supported PHP versions.
  • Two-factor login for the hosting account.
  • Certifications such as ISO 27001 or BSI C5 for higher requirements.
  • Support availability and clear uptime information.

What good hosting costs

For a company website, hosting from €0 for static sites to around €25 a month for managed hosting with backups is often enough. Shops and web applications need more resources. Contract, backups and support matter more than price. We set up websites with EU providers on your own account; domain and access belong to you.

Frequently asked questions

Is hosting in Germany mandatory?
No. The GDPR applies equally across the EU. An EU location avoids third-country transfers; whether the server is in Frankfurt or Helsinki makes no legal difference.
Is a processing agreement alone enough?
No. It's mandatory, but you also need to check security, storage locations and sub-processors and name them in your privacy policy.
What about CDNs and services like Cloudflare?
They also process visitor data. Check the contract, data locations and whether you really need the service.
